Welcome to AsinMart. These Terms and Conditions govern your access to and use of www.asinmart.com, including purchases made from sellers operating through the AsinMart multi-vendor marketplace.

By accessing the website, creating an account, placing an order, using any service, or otherwise interacting with AsinMart, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

Please read these Terms carefully before using the platform.

1. About AsinMart

AsinMart is an online multi-vendor marketplace that enables customers to discover and purchase products offered by AsinMart and independent third-party sellers registered on the platform.

Depending on the product, the seller responsible for offering, invoicing, packing, shipping, and fulfilling the product may be AsinMart or an independent seller operating a store through the marketplace.

Where a product is offered by a third-party seller, the relevant seller information may be displayed on the product page, order details, invoice, or other appropriate stage of the transaction.

AsinMart provides technology, marketplace, payment-support, customer-support, and related services to facilitate transactions between customers and sellers.

2. Acceptance of Terms

By using AsinMart, you confirm that:

  1. You are legally capable of entering into a binding agreement.
  2. The information provided by you is accurate and complete.
  3. You will use the platform only for lawful purposes.
  4. You agree to comply with these Terms and all applicable laws and regulations.

If you do not agree with these Terms, you should discontinue use of the website and services.

3. Customer Accounts

Certain services may require you to create an AsinMart account.

You are responsible for:

  1. Providing accurate registration information.
  2. Keeping your login credentials confidential.
  3. Maintaining the security of your account.
  4. Updating your contact information when required.
  5. All activities performed through your account unless unauthorized use has been promptly reported.

You must immediately notify AsinMart if you suspect unauthorized access to or misuse of your account.

AsinMart reserves the right to suspend or restrict accounts that are suspected of fraudulent activity, abuse, violation of these Terms, or misuse of the marketplace.

4. Products and Seller Listings

Products displayed on AsinMart may be listed by multiple independent sellers.

Sellers are responsible for providing accurate information regarding their products, including where applicable:

  2. Description
  3. Images
  4. Specifications
  5. Size
  6. Colour
  7. Material
  8. Quantity
  9. Price
  10. Stock availability
  11. Manufacturer details
  12. Warranty information
  13. Country of origin
  14. Taxes
  15. Shipping information
  16. Return eligibility

AsinMart takes reasonable steps to maintain marketplace quality; however, product information supplied directly by third-party sellers remains the responsibility of the respective seller.

Actual product colours may vary slightly depending on photography, lighting, display settings, or manufacturing variations.

5. Seller Transparency

AsinMart is committed to maintaining transparency regarding the seller providing products purchased through the marketplace.

Where applicable, customers may be informed of the identity of the actual seller through the product page, checkout process, order information, invoice, communication, or other transaction records.

The seller identified in the relevant transaction documents is the party supplying the applicable product to the customer.

6. Product Availability

All orders are subject to product availability.

A product appearing on the website does not guarantee continuous availability.

An order may be cancelled before dispatch if:

  1. The product becomes unavailable.
  2. Inventory information was incorrect.
  3. The product cannot be sourced or fulfilled.
  4. There is an error in the product listing.
  5. The seller is unable to process the order.

If payment has already been successfully collected for an order that is subsequently cancelled, the applicable refund will be initiated according to the Refund and Cancellation Policy.

7. Pricing and Taxes

Unless stated otherwise, all prices displayed on AsinMart are in Indian Rupees (INR).

Applicable taxes, GST, shipping charges, handling charges, platform-related charges, discounts, or other charges may be displayed separately where applicable before completion of the order.

Prices may vary between sellers for similar or identical products.

AsinMart and its sellers reserve the right to update product prices at any time before an order is successfully placed.

In the event of an obvious pricing or technical error, AsinMart or the seller may cancel the affected order and refund any amount collected.

8. Orders

Submitting an order constitutes an offer to purchase the selected product.

Receipt of an order confirmation does not necessarily mean that the order has been finally accepted for fulfilment.

Orders may be subject to:

  1. Payment verification
  2. Seller acceptance
  3. Inventory verification
  4. Fraud screening
  5. Address verification
  6. Serviceability checks

An order becomes confirmed for fulfilment after the required checks have been successfully completed.

AsinMart may limit the quantity of products that may be purchased in a single transaction or by a particular customer where reasonably necessary.

9. Payments

AsinMart may support payment methods including those displayed during checkout from time to time.

Payment processing may be provided through third-party payment gateways and banking partners.

Depending on the marketplace transaction structure, customer payments may be collected by AsinMart or its authorized payment service provider on behalf of the respective seller and subsequently settled in accordance with the applicable marketplace and payment arrangements.

AsinMart does not store sensitive card authentication information except where permitted and processed through authorized payment systems.

A payment may fail or remain pending due to reasons including:

  1. Bank or payment gateway failure
  2. Network interruption
  3. Incorrect payment information
  4. Authentication failure
  5. Transaction limits
  6. Security checks

Where an amount is debited but an order is not successfully confirmed, reconciliation and refund will be handled in accordance with the applicable bank or payment provider timelines.

10. Cash on Delivery

Cash on Delivery may be available for selected products, sellers, locations, or order values.

AsinMart may restrict or disable Cash on Delivery based on:

  1. Delivery location
  2. Product type
  3. Order value
  4. Previous order history
  5. Repeated order rejection
  6. Fraud-prevention measures
  7. Courier availability

Any COD-related or advance charges, where applicable, will be communicated before the order is placed.

11. Shipping and Delivery

Products may be shipped directly by individual sellers, fulfilment partners, or logistics providers engaged through the marketplace.

Estimated delivery dates are provided for convenience and are not guaranteed delivery commitments.

Delivery may be affected by circumstances including:

  1. Courier delays
  2. Weather conditions
  3. Natural disasters
  4. Government restrictions
  5. Public holidays
  6. Transport disruptions
  7. Incorrect customer information
  8. Remote-location serviceability
  9. Events outside reasonable control

Customers must provide complete and accurate delivery information.

AsinMart and the seller shall not be responsible for delivery failures caused by incorrect, incomplete, or outdated addresses provided by the customer.

12. Order Tracking

Where available, customers may track orders through their AsinMart account, tracking page, notifications, or courier tracking services.

Tracking status may occasionally be delayed because information is received from external logistics providers.

13. Cancellation

Orders may be cancelled subject to the applicable cancellation policy and the fulfilment stage of the order.

Customers may not be able to cancel an order once the product has been packed, shipped, or reached a stage where cancellation is no longer operationally possible.

AsinMart or a seller may cancel an order due to:

  1. Product unavailability
  2. Incorrect pricing
  3. Payment verification issues
  4. Fraud concerns
  5. Invalid delivery address
  6. Seller fulfilment failure
  7. Technical errors
  8. Legal or regulatory requirements

Where applicable, refunds for cancelled prepaid orders will be processed according to the Refund Policy.

14. Returns, Replacements and Exchanges

Returns, replacements, and exchanges are governed by AsinMart's applicable Return, Replacement and Refund Policy and may vary based on product category and seller.

To qualify for a return, products may be required to be:

  1. Unused
  2. Unwashed
  3. Unaltered
  4. Undamaged
  5. Returned with original packaging
  6. Returned with original tags
  7. Returned with accessories and free items
  8. Returned within the specified return period

AsinMart or the seller may request photographs, videos, packaging evidence, or other information to verify a return request.

Certain products may be non-returnable because of hygiene, safety, customization, perishability, licensing, or other product-specific reasons.

Eligibility will be communicated through the relevant product or return policy.

15. Refunds

Approved refunds will ordinarily be processed to the original payment method unless another legally permitted refund method is communicated.

Refund completion time may depend on:

  1. Payment method
  2. Customer's bank
  3. Payment gateway
  4. UPI provider
  5. Card network
  6. Marketplace reconciliation requirements

AsinMart is not responsible for processing delays occurring solely within a customer's bank or external payment network after a refund has been successfully initiated.

16. Product Quality and Authenticity

Sellers are expected to list genuine and legally permitted products.

The sale of counterfeit, stolen, unsafe, prohibited, misleading, or unlawfully sourced products is prohibited on AsinMart.

AsinMart may suspend listings or seller accounts when credible concerns regarding authenticity, safety, regulatory compliance, intellectual property, or product quality arise.

Customers who believe they have received an incorrect, counterfeit, defective, or materially different product should contact AsinMart customer support within the applicable return or complaint period.

17. Product Warranties

Any manufacturer or seller warranty applicable to a product will be governed by the terms provided by the relevant manufacturer or seller.

Unless specifically stated, AsinMart does not independently provide a manufacturer's warranty for products sold by third-party sellers.

Customers may be required to contact the manufacturer or authorized service centre for warranty claims.

18. Reviews and Ratings

Customers may be permitted to submit product reviews, ratings, photographs, and other feedback.

Reviews must reflect genuine experiences and must not contain:

  1. False or misleading information
  2. Abusive or threatening language
  3. Unlawful material
  4. Advertising or spam
  5. Personal information belonging to another person
  6. Infringing content
  7. Manipulated or fraudulent reviews

AsinMart may remove or moderate content that violates marketplace policies or applicable law.

19. Coupons, Offers and Promotions

Discount codes, promotions, marketplace offers, cashback offers, and seller offers may be subject to separate eligibility criteria and validity periods.

Unless specifically stated:

  1. Offers cannot be exchanged for cash.
  2. Offers may not be combined.
  3. Offers may have minimum order values.
  4. Offers may apply only to selected products or sellers.
  5. Offers may be withdrawn where fraud or misuse is detected.

AsinMart reserves the right to correct promotional errors or discontinue promotions as permitted by applicable law.

20. Prohibited Activities

Users must not use AsinMart to:

  1. Commit fraud.
  2. Make purchases using unauthorized payment instruments.
  3. Interfere with website security.
  4. Introduce viruses or malicious code.
  5. Scrape or copy the website using unauthorized automated systems.
  6. Attempt unauthorized access to accounts or systems.

Third-party sellers operating through AsinMart are independent businesses.

Where an independent seller supplies a product, that seller is responsible for obligations relating to the product that are legally attributable to the seller, including product descriptions, product compliance, invoicing, packing, and fulfilment as applicable.

AsinMart may assist customers with communication, complaints, returns, refunds, logistics, and dispute resolution in accordance with marketplace policies.

Nothing in these Terms is intended to remove any consumer right available under applicable law.

22. Third-Party Services

AsinMart may use third-party service providers for services including:

  1. Payment processing
  2. Shipping
  3. Order tracking
  4. SMS
  5. Email
  6. Analytics
  7. Authentication
  8. Customer support

Use of such services may also be subject to the respective provider's terms and policies.

AsinMart shall not be responsible for interruptions caused entirely by external services beyond its reasonable control.

23. Intellectual Property

Unless otherwise indicated, the AsinMart name, website layout, platform software, logos, graphics, designs, text, interface elements, and other original platform content are owned by or licensed to AsinMart.

Product trademarks, logos, photographs, and other intellectual property belonging to sellers, manufacturers, brands, or other parties remain the property of their respective owners.

You may not reproduce, modify, distribute, commercially exploit, or use protected AsinMart content without appropriate authorization.

24. Privacy and Personal Data

AsinMart processes personal information in accordance with its Privacy Policy and applicable Indian law.

Information may be collected where necessary to:

  3. Accept payments
  4. Deliver products
  5. Prevent fraud

27. Indemnity

To the extent permitted by law, users agree to indemnify AsinMart against losses, claims, or expenses arising directly from:

  2. Intentional violation of these Terms.
  3. Unauthorized use of another person's account or payment information.
  4. Violation of applicable law.
  5. Infringement of third-party rights caused by content submitted by the user.

28. Suspension and Termination

AsinMart may temporarily or permanently suspend access to the platform where reasonably necessary due to:

29. Force Majeure

AsinMart and sellers shall not be responsible for failure or delay caused by events beyond reasonable control, including natural disasters, floods, fires, epidemics, pandemics, strikes, transport disruptions, government restrictions, internet failures, telecommunications failures, or other similar circumstances.

30. Consumer Rights

Nothing contained in these Terms is intended to restrict rights available to consumers under applicable Indian law.

Where any provision of these Terms conflicts with a mandatory consumer protection requirement, the applicable statutory requirement will prevail.

31. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable consumer protection laws and any jurisdiction granted to consumers by law, disputes shall be subject to the jurisdiction of the competent courts and authorities in Tiruppur, Tamil Nadu, India.

32. Changes to These Terms

AsinMart may modify these Terms from time to time to reflect:

33. Severability
